1. Agreement

This End User License Agreement ("Agreement") is between you ("User") and San Carlos Flight Center ("SCFC," "we," "us," or "our") for use of the SCFC flight scheduling and management application (the "Application").

By creating an account or using the Application, you agree to be bound by this Agreement. If you do not agree, do not use the Application.

2. License Grant

SCFC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Application for the purpose of:

• Scheduling aircraft and instructor reservations
• Managing your flight training and rental activities
• Viewing your account, credentials, and flight records
• Communicating with SCFC staff and instructors

This license is granted solely for your personal use in connection with SCFC's flight training and rental services.

3. Eligibility

To use the Application, you must:

• Be a current or prospective student, renter, instructor, staff member, or aircraft owner at SCFC
• Be at least 16 years of age (users under 18 must have parental or guardian consent)
• Provide accurate and complete account information

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying SCFC immediately if you suspect unauthorized access
• Keeping your profile information (certificates, medical, endorsements) accurate and current

5. Acceptable Use

You May:

• Schedule and manage your flight reservations
• View your training progress and records
• Submit squawk reports for aircraft
• Communicate with instructors and staff through the Application

You May Not:

• Share your account credentials with others
• Access another user's account without authorization
• Attempt to bypass security measures or gain unauthorized access
• Use the Application for any purpose unrelated to SCFC services
• Copy, modify, reverse engineer, or create derivative works of the Application
• Interfere with or disrupt the Application's operation

6. Intellectual Property

The Application, including its software, design, and content, is owned by SCFC and protected by intellectual property laws. This Agreement does not transfer any ownership rights to you.

7. Third-Party Services

The Application may integrate with third-party services such as Google Calendar and Stripe. Your use of these integrations is subject to the respective third party's terms and policies.

8. Disclaimers

8.1 No Warranty

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SCFC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Accuracy of Information

While we strive to maintain accurate information, the Application may contain errors. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING:

• Your pilot currency and medical certificate status
• Aircraft airworthiness and availability
• Weather and flight planning information
• Compliance with all FAA regulations

8.3 Not a Substitute for Judgment

THE APPLICATION IS A SCHEDULING AND MANAGEMENT TOOL ONLY. IT DOES NOT PROVIDE FLIGHT DISPATCH, OPERATIONAL CONTROL, OR FLIGHT FOLLOWING SERVICES. ALL DECISIONS REGARDING FLIGHT OPERATIONS ARE YOUR RESPONSIBILITY AS PILOT IN COMMAND.

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCFC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APPLICATION.

9.2 Flight Operations

SCFC IS NOT LIABLE FOR ANY DAMAGES, INJURIES, OR LOSSES ARISING FROM FLIGHT OPERATIONS, INCLUDING ACCIDENTS, INCIDENTS, OR REGULATORY VIOLATIONS. YOUR USE OF THE APPLICATION DOES NOT CREATE ANY DUTY ON THE PART OF SCFC TO MONITOR OR ENSURE THE SAFETY OF YOUR FLIGHTS.

9.3 Cap on Liability

SCFC'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO SCFC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless SCFC, its officers, employees, instructors, and agents from any claims, damages, or expenses arising from:

• Your use of the Application
• Your violation of this Agreement
• Your flight operations
• Any inaccurate information you provide

11. Term and Termination

11.1 Term

This Agreement is effective when you create an account and continues until terminated.

11.2 Termination by You

You may stop using the Application at any time. To close your account, contact SCFC.

11.3 Termination by SCFC

We may suspend or terminate your access at any time, with or without cause, including if:

• You violate this Agreement
• Your relationship with SCFC ends (e.g., you are no longer a student or renter)
• Required for safety or operational reasons

11.4 Effect of Termination

Upon termination, your license to use the Application ends. Sections 6, 8, 9, 10, and 12 survive termination.

12. General Provisions

12.1 Governing Law

This Agreement is governed by the laws of the State of California.

12.2 Disputes

Any disputes shall be resolved in the state or federal courts located in San Mateo County, California.

12.3 Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement regarding your use of the Application.

12.4 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

12.5 Modifications

We may modify this Agreement at any time. Continued use after modifications constitutes acceptance.

12.6 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

BY USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT.
